Small Problem Involving the WoM Remake

So I was recently sent this image by a friend. The problem here is that:

  • I’m assuming that a remake of WoM is an arcane universe fangame technically, even if WoM is non-canon. As such, my game falls under this category
  • I need to reuse assets from the original, including textures, animations, and sound effects, which goes against this

Now, the only exception I’ve seen so far is showcase games, but as my friend pointed out, they aren’t full on games, just build/character showcases. Other things like Arcane Reborn are supposedly permitted by Vetex to reuse original assets, or made their own copy of them. This, however, leaves me in a difficult spot. Because I have a full on game that doesn’t have explicit permission from the dev team to reuse WoM assets.

The other complication is that the message is too vague as to what necessarily falls under reused assets.
Do things not made by Vetex or someone he hired, but he uploaded, count?
Do things not uploaded nor made by Vetex or his associates but put in WoM count?
Excluding things like catalog models, since that’s obviously not part of this.
Do publicly available things like the default clothes count? They are available on the catalog if you filter to Vetex’s uploads and show unavailable items.
Does rebuilding the map from scratch and reusing dialogue count? Not sure that counts as an asset, but still.
Does reuploading things technically circumvent this? Otherwise using things like the MC or magic icons could still count as asset stealing.
Does editing the original source, even if it was made by Vetex/associates, make it no longer a stolen asset if I then use it?
And most importantly, does my WoM remake actually count as a arcane fangame? And do showcase games count as arcane fangames?

I’d like to know some insights from forumers about this. The game is currently private, as it has been for the past three years, but I want to know if it would even be allowed to ever make it public, given this message.

I’m sure you could get away with taking the same clothing, hairs, and audio, but for like, trees and stuff, wouldn’t it be more interesting to do something original?

I’d say it’s worth asking Vetex permission if I figured you could find a way to ask.

Yeah, you can also discuss with Vetex on where the line is drawn at as well so you know which borders to not cross in development

WoM trees weren’t memorable anyway I don’t think, though I’m not sure how complex of models the Roblox engine allows for

For sound effects at least, a ton of them can be freely found in the catalogue and have been used by multiple games for years. For example, Elemental battlegrounds light magic shares the same sound effect as plasma in AO. So I really doubt that he would go after you for using sound effects as long as it isn’t something created by him or the team.

(this does make me wonder if using the same music even matters either, aren’t nearly all WOM songs royalty free and created by some random person?)

Getting in contact with Vetex is a problem, to say the least. It would definitely be easier if I could make sure what he does and doesn’t permit, but I can’t think of any feasible way to be able to ask.

Yeah, almost all the music can be found freely on Youtube, and I’ve heard WoM SFX in other games before. However, I don’t fully know which are just generic/public and which are Vetex’s.
That still does leave things like animations and textures though, so there’s still some points of contention regardless.
